31 MAY 13: SNEA (I) Maharashtra Circle congratulates, Com. B. B. Pathare, DGM Kalyan, Com. R. S. Gupta, AGM Mumbai Com. S. N. Choudhary, SDE Jalgaon, Com. P. B. Bhale, SDE Solapur, Com. S. N. Jagtap, AD Mumbai, Com. B. R. Patil, SDE Dhule and Com. S.N.Mahajan SDE Jalgaon, Com. Sayyad Shahabuddin, SDE Nashik on their superannuation retirement today and wish them and their family members “A Very Happy, Peaceful & Long Retired Life”. Com. P. B. Bhale  & Com. S. N. Choudhary have rendered their services to the SNEA(I) as President SNEA(I) Solapur & Treasurer SNEA(I) Jalgaon respectively and both the comrades were instrumental in the association  activities on the platform of SNEA(I). Com. B. B. Pathare, Com. R. S. Gupta, Com. S.N. Jagtap, Com. S. N. Mahajan, Com. B. R. Patil, Com. Sayyad Shahabuddin are die-hard comrades of SNEA and have played vital role in strengthening SNEA(I) with their active support. All these comrades have contributed actively towards the growth of BSNL during their lifelong services rendered earlier in DoT and now in BSNL. SNEA (I) Maharashtra has no words to recognise their long and dedicated services rendered in BSNL and love & affection towards SNEA (I) and will always remember their active contribution for BSNL as well as SNEA (I).

SAD & SHOCKING NEWS:  SNEA (I) Maharashtra Circle deeply mourns on all of sudden heavenly exit of Com. S. R. Ram, beloved Treasurer of SNEA (I) Mumbai. Comrades, it is panic day for SNEA (I) Maharashtra Circle as we have lost a great solider of SNEA (I) Mumbai.  Com. Shyamlal R Ram was working as AD CRM EB MH Mumbai and was holding responsible position of Treasurer for SNEA (I) Mumbai. Com. Ram was on personal visit to his Home Town Saidpur Dist. Gazhipur (UP) where he was admitted in the local hospital for sudden illness on 22/05/2013 and was released from hospital. But while on way back to his home, he started pains again and was readmitted in hospital but it did not yield positive results and he passed away in the hospital in the morning hours of 23/05/2013.

Sudden exit of Com. S.R. Ram at age of just 56 years has shocked all the comrades and it is deep loss to his bereaved family. His exits has created big vacuum in SNEA (I) Mumbai and is irrecoverable loss to entire SNEA (I) family. BSNL also lost its very active, sincere and dedicated Officer. Com. Ram was known for his pleasant & friendly appearance and he was loved by one and all. He has large friend Circle throughout Maharashtra Circle. He has very active role in building SNEA (I) Mumbai with grass root level activities and his contribution & dedication cannot be expressed in words. SNEA (I) Maharashtra prays almighty to give courage to family members of late Com. S.R. Ram to come out of this life time crises and prays for heavenly space and peace for departed soul of Com. S.R.Ram.

We appeal to all comrades in Circle Office Mumbai to join the Condolence Meeting to pay homage to beloved Com. S. R. Ram at 1130 hrs on 24/05/2013 at 2nd floor Conference Hall, BSNL Admn Bldg. Santa Cruz (W) Mumbai.

 

24 MAY 13: The complaint of SNEA (I) Maharashtra Circle dated 25/03/2013 addressed to CGMT MH and copes marked to all concerned is taken note by Vigilance Cell of BSNL and now GM TR Mumbai has issued orders for Recovery of the illegal grant of free calls beyond limits on FSRTC in Maharashtra Circle. Letter clearly says that neither the calls made above the free limits are eligible for waiver nor such limit can be enhanced at any circumstances and additional charges will have to be paid by individual Official/Officer. It is important to note that such cases have been confirmed by TR Section and hence orders for recovery are issued in general and no specific mention of cases and names of officers are given who have made deliberate loss to BSNL for personal benefits misusing their official position.

           Comrades, SNEA (I) MH will not leave this complaint in between and this is first step to recover the BSNL Money, and we will pursue the complaint till the entire Money is not recovered from such selfish Officers and departmental action for “misappropriation of BSNL funds” is not taken against such culprit officers who have taken personal benefits and have granted personal benefits only to their well-defined group of “chamachas”

 

24 MAY 13: BSNL is incipient sick when it is question of legitimate payment to its bonafide absorbed employees whereas it suddenly becomes healthy when vested interests having no stake in the Company are to be paid- nonsense, ridiculous, deplorable, shameful, irrational.

Comrades, come on to the streets to smash, expose and defeat this sinister conspiracy of DOT bureaucracy and BSNL management.BSNL is led by plunderers out and out committed to mortgage the Company and its employees to satisfy vested interest ITS at any cost whatsoever. Can we accept such indignity and ignominy? We have to decide. It is a real do or die moment for all of us. Let us teach bureaucracy in DOT and BSNL management a befitting lesson for their insensitive, irresponsible, shameful and deplorable act of denigrating and humiliating BSNL employees and mortgaging the Company and satisfying vested interests. Make the Organizational programme on 5th June and indefinite strike from 12th June a monumental success and send BSNL Management to barracks.

 

24 MAY 13: Out rightly condemn the retrograde orders issued by BSNL Management to extend the benefits of pay and allowances to vested interests deployed to BSNL. Don’t allow said retrograde issued to be implemented unless our just and legitimate issue of merger of 9.4% IDA is resolved. Bring BSNL to a grinding halt. Don’t allow such humiliation and trampling over of absorbed BSNL employees. Siege BSNL on 5th June and bring it to a grinding halt from 12th June till our legitimate issue of merger of 9.45 IDA is resolved.

Comrades get fully ready for a real do or die struggle by making the Organizational programmes on 5th June and 12th June an astounding success so as to convey a befitting lesson to deplorable, insensitive, irresponsible and prejudiced and vested interest BSNL Management and bureaucracy in DOT- We deplore and condemn both bureaucracy in DOT and BSNL Management for issuing retrograde order dated 21st May,2013 extending all the benefits of pay and allowances as are admissible to government officers of the equivalent grade to ITS deployed to BSNL. This shameful and ridiculous action of BSNL Management to extend benefits to deputationists and deny legitimate merger of 9.4% IDA with basic to absorbed employees has no parallels. BSNL management has completely lost propriety and legitimacy to lead BSNL and cannot escape its responsibility by maintaining that it has cleared the proposal of merger of 9.4% IDA and DOT is holding it up.

BSNL Management is so much insensitive, deplorable and irresponsible that it did not even wait for the outcome of the proposal sent by DOT to BRPSE regarding merger of 9.4% IDA with basic and instead issued the orders extending benefits of pay and allowances to ITS deployed to BSNL. Disgraceful on part of both bureaucrats in DOT as well as BSNL Management. BSNL is led by plunderers who are out and out mortgaging the Company and killing its employees and we have to drive out these plunderers from the Company.

Comrades, It all depends on our solidarity, unity and commitment and our capacity to hit back ferociously to salvage our dignity and comprehensively defeat and drive out those who want to slaughter us and sell the Company to satisfy vested interests under all Circumstances and at all costs. We have to stand up like a rock and hit back. We have absolutely nothing to lose, nothing to fear. Come out fearlessly, courageously and comprehensively defeat humiliation inflicted on us by DOT/BSNL Management. Justice will eventually and surely prevail and conspiracy will be definitely exposed and defeated.

 

24 MAY 13: Meeting with Director (Establishment)/DOT: We understand reliably that DOP&T has cleared a reference received by it from DOT regarding distribution of TES Gr B vacancies between seniority cum fitness and competitive quotas. BSNL had sent a note to DOT to clarify as to how TES Gr B vacancies are to be distributed between seniority cum fitness and competitive quotas. Thereafter, DOT sent proposal to DOP&T for clarification. This association has had been vigorously pursuing to get necessary clarification from DOP&T. We requested Director (E)/DOT to track the file and send the necessary clarification to BSNL. Director (E) assured that he will keep a close watch on the file and send it as quickly as possible to BSNL. With this clarification, one of the major hurdles in the way of JTO to TES Gr B seniority cum fitness promotions would be over.

 

24 MAY 13: Meeting with DDG (TPF)/DOT: President along with AGSs, Com Dahiya and Com Wankhede, met DDG (TPF)/DOT, Sh Shahbaz Ali, and apprised him about retrograde orders issued by BSNL Management extending all the benefits relating to pay and as admissible to the government officers of the equivalent grade to ITS deployed to BSNL while denying legitimate merger of 9.4% IDA with basic to absorbed employees of BSNL. DDG (TPF) felt extremely concerned about such discriminatory moves of BSNL Management and assured that government Directors in BSNL/Board are getting very tough on such moves.

            We also informed DDG (TPF) about the outcome of our discussions with Secy/BRPSE. DDG (TPF) mentioned that the decision to refer the issue of merger of 9.4% IDA with basic was taken by nodal agency of DOT and Dot/Finance has always been very positive and favoured merger of 9.4 % IDA with basic to employees of BSNL. DDG (TPF) assured that DOT/finance will do its level best for early settlement of this issue. We expressed our profound thanks to DDG (TPF) for his positive approach to resolve this issue.

 

23 MAY 13: Comrades throughout Maharashtra Circle actively participated in the Lunch Hour Demonstrations to register their protest against undue delay by BSNL and DoT in granting 78.2% IDA merger as per the agreement signed between the BSNL Management and BSNL Unions/Associations on 12.06.2012. We have received reports from different districts wherein hundreds of comrades have participated in the Lunch Hour Demonstrations. 22 MAY 13: Lunch Hour Demonstrations Toady: Lunch Hour Demonstrations as per call given by Forum of BSNL Unions/Associations CHQ for trade union actions on 78.2% IDA merger w.e.f 01.01.2007 as per the agreement signed between the BSNL Management and BSNL Unions/Associations on 12.06.2012 will be held throughout Maharashtra toady. Comrades, nearly one year period passed, but the said file is being shunted from One Table to another Table and by now it is clear that DoT as well as BSNL management are playing with our bread and butter. One side our legitimate demand is being rejected by indirect methods for last Five years on name of financial crises and other side and at the same time, the officers on illegal deputation cum deployment in BSNL are granted allowances without any reference to Financial crises of BSNL, this is extreme case of biased approach and injustice to its own employees by BSNL as well as DoT managements and needs its exposure by one and all. This double stand needs opposed by every employee and officer of BSNL by active participation in today’s Lunch Hour demonstrations, which is first step of this agitational programme. SNEA (I) Maharashtra appeals all the comrades regardless of Unions/Associations to come forward and register their strong protest against this dual policy with active participation and make it grand success.

22 MAY 13: Meeting with Director (HR): President and AGS, Com A. Dahiya met Director HR and had discussions on following issues:

A.    Expeditious action to amend BSNL MS RRs to make non engineering graduates eligible for STS promotions in Civil/Electrical streams: Director (HR) was apprised in detail about immediate need to amend BSNL MS RRs so as to bring complete parity in functional promotions between Civil/Electrical and Telecom/Finance streams by suitably and quickly amending BSNL MS RRs. We impressed upon Director (HR) that parity in Pay scales and EPP has already been brought about between Civil/Electrical and Telecom/Finance streams. Only in area of functional promotions, serious and unwarranted discrimination continues to exist which needs to be addressed as quickly as possible, we informed Director (HR).  Director (HR) was very positive and indicated that BSNL Management is considering making appropriate amendments in RRs to end existing discrimination and bring about parity in all respects. We pleaded with Director (HR) to take immediate decision and he assured that positive action to amend RRs would be initiated very soon. However, Director (HR) asked us to gather inputs from CPWD in this regard as to what mechanism CPWD is following in this regard. Very shortly, we shall submit our latest feedback from CPWD to Director (HR). CHQ will vigorously pursue the issue.

B.     Membership verification: We categorically informed Director (HR) that it is completely unfair and unreasonable on the part of BSNL Management to delay initiating membership verification among executives. For the last three years Association has been pleading for membership verification and Management is simply ignoring our repeated pleas in this regard. Association will not allow any further delay in conducting membership verification and action on war footing must be initiated to conduct membership verification. Director (HR) assured that Management is very keen and serious to conduct membership verification as quickly as possible and GM (SR) has been instructed to finalize modalities to conduct membership verification as early as possible. We suggested that membership verification should not be delayed beyond six months in any case whatsoever since it is illegitimate not to conduct membership verification when number of Associations are representing executives.

C.     Expeditious action to complete JTO to TES Gr B and TES Gr B to STS promotions: We informed Director (HR) that since major legal hurdles in the way of conducting DPCs for both promotions are cleared, it is high time that expeditious action is taken to pave the way for holding DPC for both promotions as early as possible. We solicited personal intervention of Director (HR) and requested him to closely monitor progress on both DPCs personally. Director (HR) was emphatic in mentioning that Management is very eager to complete both DPCs as early as possible and assured that he will personally monitor progress in respect of both DPCs.

In the morning, we had detailed discussions with GM (SR) for finalizing the modalities for membership verification as early as possible so as to complete the entire process not exceeding six months.

21 MAY 13:Hon. PB CAT New Delhi delivered judgment in LDCE Case: Hon. PB CAT New Delhi did not cancel LDCE examination. However, Hon. PB CAT adjudicated that answer key will have to be finalized afresh in accordance to the opinion of the expert committee set up by BSNL management. This means that fresh evaluation of candidates who appeared in the LDCE would be done in accordance to the new answer key. Hon. PB CAT also observed that BSNL management has by and large conducted the examination in transparent and clear manner. The Hon. PB CAT further directed the BSNL management to complete the process within 2 months. Detailed judgment running in about 70 pages is awaited within a couple of days.

Association impleaded in the case and strongly pleaded that this said examination should not be cancelled. With this judgement of PB CAT, New Delhi, all OAs transferred from various Tribunals in the country are disposed off

20 MAY 13:  Good News for EPF Account Holders:  The long pending data of EPF for year 2010-11 has been submitted by BSNL Maharashtra Circle to EPF Bandra, today. This is major step towards resolving pending EPF grievances and will give breakthrough to the further process of updating EPF data in individual EPF account for all concerned comrades.

 

20 MAY 13:  Waiting list of BSNL Quarters in Mumbai:  Maharashtra Circle issued final waiting list of staff Quarters in Mumbai. Process of allotment of vacant quarters to individual applicants will be completed as per this waiting list in coming days. Letter <<<>>>

18 MAY 13:  Meeting with CMD/ BSNL: GS, President and AGS Com V M Wankhade met CMD/BSNL and discussed the following issues:

a.     78.2% IDA merger with basic w.e.f 01.01.2007: Assn informed CMD about the meeting took place on 16.05.2013 with Secretary/BRPSE and the stand of BRPSE on this issue. Further we requested CMD to take up the matter with Secretary, DoT for approval of the same. CMD informed that he had already taken up the matter with Secretary, DoT and further he will speak to Secretary in this regard for early settlement.

b.    Membership verification among Executive Associations: We very strongly demanded the membership verification among Executive Associations and requested CMD to expedite the verification process. CMD informed us that Management has already taken a decision to conduct membership verification among the Executives Association and the process will be started shortly. Immediately CMD directed DIR (HR) to expedite the process of membership verification. Comrades throughout the country should get ready for the membership verification in the shortest time.

 

17 MAY 13: Latest status of 78.2% IDA fixation: GS, President and AGS Com V M Wankhade met Ms S Rawla, Secretary, BRPSE with prior appointment and discussed about the status of the proposal of DoT on the subject matter. Sri V K Jindal, Director/BRPSE was also present in the meeting. Secretary and Director/BRPSE informed us that no such proposal was received by BRPSE from DoT so far. Further Secretary/BRPSE categorically told us that BRPSE is dealing with the revival of sick PSUs and its revival as a whole package and not dealing with small issues like this. As far as pay revision related issues are concerned, BRPSE is only dealing with sick PSUs where the pay revision is not implemented since 1992. BSNL is not at all a sick PSU and hence BRPSE is not having any role in the matter. Now the revival of BSNL is referred to a GoM, a higher body and hence BRPSE is having no more role to play on revival of BSNL. She categorically told us that this is an internal matter of DoT and it has to be decided internally only. Even if the proposal is send to BRPSE, BRPSE will take this stand and shall return the matter back to DoT, informing DoT that the issue has to be decided internally by DoT. Secretary/BRPSE further stated that this is high time to keep the employees highly motivated when BSNL is facing decline in growth and revenue and such issues has to be decided as quickly as possible to keep the morale of the employees. By this our stand that this issue need not be referred to BRPSE as BSNL is not under the purview of BRPSE vindicated.

From this development it is clear that some vested interest in DoT is deliberately delaying the decision on 78.2%. Their intension was very clear from the day the agreement was signed between BSNL Mgt and the BSNL Unions/Associations. More than 11 months passed. Comrades, this is high time to respond organisationally and unless and until we are protesting in the strongest way, this issue will not be resolved by DoT. Get ready for that. Prepare for the organizational actions from 22.05.13 and indefinite strike from 12.06.13 till the orders are issued by DoT.

It has been observed that some of comrades in long stay list keep quiet about their wrong data in long stay list when actually long stayed list is published and becomes panic for cancellation of transfer orders which are issued on basis of this long stay list. As such all comrades coming under zone of SDE long stay list in Maharashtra Circle are requested to go through this list carefully and send their detail representations without any delay for corrections of their stay, age if any or about names of other officers having more long stay but not shown in this list etc.

16 MAY 13: BSNL CO calls for stay particulars of 25 long stayed SDEs from each Circle/Unit, counting their stay from JTO cadre onwards and who are below the age of 55 years as on 31 March 2014.  In a letter giving clear guidelines in counting stay of executives, no consideration is given for excluding stay in MTNL Mumbai from long stay as being managed by Mr. Chakrapani Adiga, DGM HR & Admn and his team for years together just to exclude their own names from long stay list of officers and safeguard themselves from the long stay transfer thereby taking personal benefits using official position and sending their juniors in stay out of Maharashtra Circle to hard tenure on the name of long stay.  It has been mentioned in the Format for submitting long stay data to “Total continuous stay in the circle territory at present station (considering both territorial & non territorial circles) starting from JTO/JE cadre, which clears the matter. This will be applicable for all executives having age less than 55 years as on 31 March 2014 and who have managed their transfers from Maharashtra Circle to non recruiting Circles like ITPC Pune, WTR & WTP within territory of Maharashtra Circle and vice a versa, just to escape from the list of long stayed SDEs in their parent Circle and now their stay will be counted considering stay in territorial as well as non territorial circles starting from JTO/JE cadre.  Letter <<<>>>

·        Com. Kishor Kapgate, DS SNEA (I) Gadchiroli submitted brief report to the house about the latest Gadchiroli developments as well as the problems of Gadchiroli Comrades. Com. Kapghate conveyed sincere thanks to Circle office bearers and CHQ  leaders for their constant and efficient efforts to make the Gadchiroli  SSA, first as Circle Tenure and now as  all India  tenure and explained how the comrades of Gadchiroli are being benefitted in particular with this Tenure facility and how it is useful for comrades of Vidarbha region. He categorically mentioned the situation before Tenure and situation after declaration of Circle Tenure. By narrating actual hard and difficult situation in Gadchiroli, he requested for further steps and efforts to declare Gadchiroli as “All India hard tenure”. Other issues discussed shortage of staff and problems of relievers after completion of tenure. As many schemes of EB Projects and state Govt like LWE Project, DSPT Project, NOFS Project are under process but justified staff yet not posted in Gadchiroli, which has created many problems in installing and maintaining the projects. Com Kapgate demanded for extra BSC and additional BTS for Gadchiroli mobile wing.

·        In reply of all these demands, CS assured for the perceive of all these demands. Especially for all India hard tenure demand, CS requested for justification & required data for hard tenure and for sending the same with strong recommendation of SSA Head. Apart from this he discussed the national issues like ITS absorption, 78.2% DA etc. Further, he appealed to leaders of various union and associations to unite and make Joint forum strong. He also discussed various issues of BSNL.

15 MAY 13: GS SNEA(I) CHQ writes to Dir (HR) Regarding immediate intervention to bring about complete parity in functional promotions and end discrimination between Civil/Electrical/Arch and Telecom/Finance Executives by appropriate amendments of BSNLMS RRs. Letter <<<>>>

 

15 MAY 13: Forum of BSNL Unions / Associations meeting with CMD BSNL: The representatives of Forum of BSNL Unions/Associations met CMD BSNL and discussed on the memorandum submitted to the GoM on the revival of BSNL/MTNL and the issue of 78.2% IDA fixation with basic. CMD appreciated the concern of BSNL Unions/Associations and mentioned that this is the right time to apprise all the members of the GoM regarding issues related to Viability of BSNL and its revival. He mentioned that BSNL Management has also given the presentation to DoT on 8th & 9th May, 2013 on this issue. We apprised him that the memorandum has been given to the members of GoM as well as being given to all the Hon MPs throughout the country to apprise them on the issue. Forum is trying to meet the GOM members also.

CMD apprised in brief that Govt.  is planning for revival plan in three phases i.e. Short Term, Medium Term and Long Term Plans. The GoM meeting was scheduled to be held on 10th May 2013 but it has been cancelled, hence we have sufficient time to brief GoM. On the issue of 78.2% IDA fixation, the Forum leaders demanded that the orders be issued without any further delay. On 12.06.2013, one year will be over after the strike agreement on 78.2% IIDA fixation and Management has to ensure that the agreement is implemented. Forum also suggested that CMD may pursue the matter with BRPSE also to which it has been referred to. On the issue of 78.2% IDA fixation, CMD also agreed that presently BSNL is making losses but BSNL is not a sick industry, hence the case should not have been sent to BRPSE for comments. However, he assured to discuss the matter with senior level officers in DoT as well as BRPSE for early settlement.

He also mentioned that this year loss is expected to be about 8200 Crores which is Rs. 680 Crores less than the last year which gives us lot of hope for the revival. He also mentioned that the salary payment and OPEX charges are about 91.5% of the earnings and only 8.5% funds remains available for the developmental activities. On CAPEX BSNL has taken loan of about Rs. 2000 Crores. But this can be repaid immediately on receipt of Rural Subsidy of Rs. 2750/- from USO fund as per the decision of Telecom Commission.

On the query of BSNL/MTNL merger, he mentioned that it is a long term plan of Govt. to have a PSU having Pan India presence. Merge of BSNL/MTNL provides many strategic advantages to these PSUs but some staff related issue like higher pay scales in MTNL and Rule-37A Pension in BSNL and listing of MTNL etc needs solution. He appealed that BSNL Unions/Associations and BSNL Management should work in tandem to protect BSNL.

15 MAY 13: Another formality completed by AO (Mobile) Mumbai by endorsement of the SSA wise Annual Revenue Targets in GSM wherein target for Year 2013-14 for Maharashtra Circle is 1008 Cr. GSM Revenue Targets 2013-14. <<<>>>

 

15 MAY 13: DGM S&M Mumbai issued revised targets for GSM connections in year 2013-14 for Maharashtra Circle by cancelling earlier Targets assigned by NWP CM section and total target for Maharashtra Circle will be 19,90,962 lines instead of 5,45,000 earlier given by NWP CM section. Thus, the GSM targets for Maharashtra Circle are now increased by about four times than earlier targets. Different sections are issuing different targets for GSM connections, but nothing is happening on actual requirements to active these targets. Maharashtra Circle has to achieve this target when present GSM equipment capacity in Maharashtra Circle is overloaded by more than 200% and key work of expansion of SGSN & GGSN is pending for last 2-3 years giving congestion of more than 1000% for 3 G Services. 14 MAY 13: After taking valuable time of more than two months in calculation of vacancy positions and different queries, asking justification from SSA Heads, Maharashtra Circle issued order for continuation of officers already working as DE L/A for 180 days without filling number of vacant posts in different SSAs against refusal/transfers/retirement and without following latest guidelines issued for issuing DE L/A after promotion on basis of Circle seniority.

SNEA (I) Maharashtra has already brought to notice of Shri. Praveen Malholtra, Sr. GM HR & Admn Mumbai the game plans of Shri. Chakrapani Adiga, DGM HR &Admn Mumbai to safe guard his personal interest. But it seems that Mr. Adiga has taken over the command of office of Sr GM HR & Admn Mumbai in new scenario and running his old agenda of degrading his own colleague to prove his so called expertise in eyes of CGMT MH & Sr GM HR/Admn Mumbai which he could not succeed during period of earlier Sr GM HR & Admn Mumbai as he was controlled at every level of such acts by then GM HR & Admn as he was well aware about game plans of Mr. Adiga and this control seems to be disappeared in recent changes in administration. 

In this case also, we have categorically brought to notice of present Sr. GM HR & Admn Mumbai the facts well in advance and may be reason that instead of issuing orders as prepared by so called valuable guidance of Mr. Adiga, now extension of old order is issued to fulfill ego of Mr. Adiga and at the same time to show that views expressed by SNEA (I) MH are also given concern. It is unfortunate that Mr. Adiga continues to degrade his own colleges and troubling executives by creating intentional problems at every stage by using his knowledge at the level of AD Staff on promoted post as DGM HR & Admn in same section with clogged mindset as he does not know the real problems of BSNL field officer. This happens, as he has never worked in any field units of BSNL and is successful in managing his posting only in Mumbai during his entire service of 30 years and above.

No problem comrades, SNEA (I) MH will pursue with its demand that if Looking After orders are to be issued at Circle level then it should be issued as per guidelines from BSNL Corporate Office on the basis of “Circle seniority” of all comrades coming in zone of consideration. If it is to be issued as per District level seniority for avoiding transfers even though certain percentage of transfers are permitted by BSNL CO and certain comrades are ready to accept such L/A promotion on transfers, if they are given opportunity, then it is need of time that instead of unwanted business of issuing Looking after orders from Circle and wastage of time & manpower in repeation of works, the powers for looking after arrangements/promotions should be delegated to SSA Heads and Circle Office will made available present Circle seniority list in SDE cadre. Let SSA Heads maintain the seniority among promoted officers within district, let them take decision on refusal and posting against such refusals, let them take care of real field problems which are different from SSA to SSA and no need to waste time and manpower doubly i.e. at Circle Level and again at District level.

It is important here that no DPC is being conducted for Looking after promotions and no Circle level Seniority is maintained but time of moths together is taken by Circle administration in issuing Looking after arrangement. This may be fact, with reduction of such unwanted works from circle office, the workload of Mr. Adiga will be reduced and he will be relieved to Karnataka Circle as his order is pending for period of last one year and on name of one or other idea Mr. Adiga his making sincere efforts not to get relived from Maharashtra Circle. The earlier targets for his reliving to Karnataka Circle, which are fixed in file time to time by CGMT MH Circle, Sr. GM HR & Admn Mumbai, are cancelled on the basis of such unjustified works. Maharashtra comrades will have to keep patience and continue to bear with such an officer and his useless ideas till further period of two weeks as now latest target for reliving of Mr. Adiga to Karnataka Circle is fixed in the file 31 May 2013. If Mr. Adiga did not continue to take grip of office of GM HR & Admn Mumbai by using different clever ideas and get his reliving further extended as happened in about 8-10 occasions during past one year, he will be relived to Karnataka Circle on 31 May 2013.

Comrades, our concern is to follow the well framed policy guidelines by BSNL CO and at the same time executives are not deprived from their basic right of promotion as per seniority after wait of minimum 12-15 years on name of expenditure curtailment and BSNL working is made to suffer by keeping post vacant for years together that to be in such purely temporary arrangements due to useless ideas of some individual officer with clogged mindset. This is our main concern, which is not understood only by Mr. Adiga mainly due to fear of reduction of his workload to justify his non reliving from Maharashtra Circle to Karnataka Circle even all other officers AD Staff, AGM Staff and Sr. GM HR & Admn Mumbai were fully convenienced during our discussions we had with each one. 9 MAY 2013: Forum of BSNL Unions/Associations taken decision to go for Indefinite strike i.e. 12.06.2013, demanding immediate settlement of 78.2% IDA merger: The meeting of the Forum, which took place today the 09-05-2013, has taken the historic decision to go on indefinite strike, demanding the immediate settlement of 78.2% IDA merger. After the agreement on 12.06.2012, eleven months passed and the Associations/Unions were pursuing the issue at all levels. The issue of 78.2% IDA merger was sent to DoT for its approval. However, DoT, instead of giving its approval, has referred the matter to the BRPSE (Board for Reconstruction of Public Sector Enterprises). This is nothing but putting 78.2% IDA merger in the cold storage.

After discussing the issue threadbare, the Forum has decided to give call for the following agitational programmes. The meeting was attended by Com.V.A.N.Namboodiri (Convener) com. P. Abhimanyu, GS/BSNLEU, Com. C. Singh, GS/NFTE, Com. K. Sebastin, GS/SNEA(I), Com. Prahalad Rai, GS/AIBSNLEA, Com. Jayaprakash, GS/FNTO, Com. Suresh Kumar, GS/BSNLMS, and Com. S. P. Sharma, President/WRU. Forum given sufficient time for the BSNL Management and DoT to settle the issue.

AGITATIONAL PROGRAMME:

1) Demonstrations on 22-05-2013 at SSA / Circle HQ and BSNLCO.

2) Dharna on 05-06-2013 at SSA/Circle HQ and BSNLCO

3) Indefinite Strike from 12-06-2013 onwards.

CHQ calls upon the circle, district and branch level organisations to immediately swing into action to make the agitational programme hundred per cent success. The joint appeal of all the General Secretaries will be issued tomorrow. Notice will be issued next week

8 MAY 13: Meeting with GM (SR): GS, President and AGS Com H Muthu met GM (SR) and held detailed discussion on the following demands placed in our letter dated 22.04.2013:

a.     Implementation of standard pay scales of E2, E3 for JTO/JAO, SDE/AO and equivalent cadres instead of intermediate pay scale of E1A and E2A as per Govt directions and repeated reminders from DPE,

b.    Implementation of CPSU Cadre hierarchy or Time Bound Functional promotions with change of designation,

c.      Filling up all vacant DGM, DE, SDE posts till implementation of CPSU cadre hierarchy /Time Bound Functional promotion,

d.    Centralised payment of EPF for all the BSNL directly recruited Employees,

e.     Settlement of pay anomaly cases due to implementation of EPP where seniors are getting less pay than the Juniors and

f.      Antedating issue on pay revision (Anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay) on implementation of 2nd PRC. This meeting has been arranged by GM (SR) based on our letter dated 22.04.2013.

 

7 MAY 13: Com. K. Sebastin, GS SNEA(I) CHQ writes to CMD, BSNL regarding proposed condemnable move to abolish STS/JAG/SAG/HAG posts transferred to BSNL on 01.10.2000 by DoT along with the Assets and Establishment– yet another retrograde move to somehow establish these posts belong to DoT to protect the interest of repatriated ITS in DOT. 6 MAY 13:Meeting with PGM(BW): Com P. Padmanabha Rao, Jt. Sec(South) & Com A. Chandra Sekhar, AGS met PGM(BW) Shri A.K.Gupta, DGM(BW) and DGM(HR) and discussed the following major issues along with others:

1)    Change in BSNLMS RR to make Diploma holders also eligible for EE promotion at par with other streams: This is one major issue Assn taking up with the Management for long time and GS had few interactions with PGM (BW) in this regard. This issue again discussed today and Management responded very positively. We are pursuing the matter at higher level also.

2)      JTO(C) to SDE(C) under Seniority Quota: VCs received from AP, CHG, KTK, PB, NE-I, MH (Partly). VCs yet to be received from the following Circles: AS, BR, GUJ, HR, J&K, KRL, MH, MP, OR, RAJ, TN, UAL, UP (E), UP (W) & WB.

3)      Entry level Training for SDE(C): After detailed discussion, management agreed to give exemption to the SDEs, those who are not undergone entry level training in the cadre of JTO(C).

6 MAY 13: Cheating to public on name of leasing out land for BSNL Mobile towers by a Fraud Company continues: SNEA (I) Maharashtra has come across another case in which fraudulent peoples have trapped another person Shri. Kashinath Nathu Mhatre from Roha in Raigad district. He also has approached this group seeing the advertisement in “Dainik Punyanagari’ for leasing of land for BSNL 3G Mobile tower. First, he was asked to deposit Rs. 1650.00 in the bank account No. 31972605885 with name of Mr. Manoj Singh in State Bank of India for preparation of documents, which he had deposited. Then he received the letters of “No Objection Certificate” for installation of tower on letter head of Government Of India with assurance on letter pad of another company wherein he is assured rental of Rs. 80,000.00 per month, advance of Rs. 20 lakhs, 20% increase in rentals every year, job for one person and agreement period is informed as 20 years. He is now directed to pay Rs. 24999.00 as Government Tax. Again, sms was sent him to deposit Rs. 3100.00 now in bank Account No. 32355053609 in State bank Of India on name of Mr. Rehan Ansari as processing fee. Shri. Mhatre got some doubt and inquired with the person calling telephonically about the office address of the company. He was informed that the calls are being made by the head Office at Andheri, Mumbai. To confirm facts Shri. Mhatre had come from Roha to Mumbai on 4 May 2013 and naturally approached to so called BSNL Andheri Office, where BSNL is having only quarters and from there Shri. Mhatre was directed to BSNL Santacruz office as if really this was call from BSNL Office. Here in Santacruz office, he met to our comrade who was alert on such fraud cases due to our earlier news dated 23 April 2013, she immediately directed same person to Com. Anil Dubey, DS SNEA(I) Mumbai and we have come to know another case of fraud. We are surprised to see the advertisement in the daily News Paper “Punyanagari’, which is given on name of BSNL and the documents being issued on name of Govt Of India and how openly public is being cheated on name of BSNL. Thanks comrade, our vigilant comrades have saved thousands of rupees of Shri. Mhatre as he was explained the reality   by creating faith about activities of BSNL in his mind and was further advised not come in any such trap on name of BSNL. 2 MAY 13: GS SNEA (I) CHQ writes to Secretary DOT regarding Calling volunteers from repatriated ITS back to BSNL– Preposterous and motivated move to safeguard vested interest of ITS, inflict huge damage of growth and viability of BSNL and defeat the absorption process - Cabinet decision contemptuously overlooked --BSNL will only flourish if it has top management which has a direct stake in the Company. The viability of BSNL severely affected by the continuation of the unabsorbed ITS Group “A” officers at the key positions as Circle/State heads and SSA/Dist heads. Instead of promoting the absorbed officers to the key and strategic positions and to build a BSNL Management of its own, the biased BSNL management in collusion with some senior officers in DoT is working overtime to continue the deputation and even to bring back the repatriated officers back to BSNL/MTNL. 2 MAY 13: Deployment of ITS officers of DoT in BSNL on BSNL posts — court case at Hon PCAT, New Delhi: The interim prayer for stay, in the OA filed by SNEA(I) & BSNLEU and AIBSNLEA against deployment of ITS officers from DoT to BSNL came up for hearing in the Hon PCAT today. Our advocate pleaded that DoT has violated earlier Hon PCAT Order dated 01.06.2011 filed by the absorbed officers as well as Hon High Court Delhi order dated 17.04.2012 for repatriation of unabsorbed ITS officers from BSNL/MTNL to DoT and deploy them in Govt service through surplus cell. Subsequently two applications for extension of time also dismissed on 18.05.2012 and 15.02.2013. The prayer made by the DoT in the Hon HC based on the cabinet decision dated 13.02.2013 “to repatriate the ITS officers and deploy them back in BSNL/MTNL” was also rejected by the Hon HC on 04.03.2013. Even after that DoT issued order for deployment of ITS officers in BSNL/MTNL on 11.03.2013, the same prayer dismissed by the Hon HC on 04.03.13. In the WP 1803/2013 filed by us in the Hon HC against this order, Hon HC observed in the judgement that “ the order dated 11.03.2013 is in letter and spirit violates the order of Hon HC dated 15.02.2013” and directed us to approach the appropriate forum for relief, that is why we are here in the PCAT, our lawyer pleaded. Hon bench very much convinced on our arguments.

We strongly pleaded for the stay of operation of the order dated 11.03.2013 of DoT, deploying the unabsorbed officers in BSNL. Counsel for DoT and BSNL pleaded for some more time to file the counter reply. Sensing the game plan of DoT and BSNL to delay the case, our lawyer pressed for the interim relief to stay the operation of DoT/BSNL order dated 11.03.2013. Hon High Court after hearing the arguments from both sides decided to hear the case on merit immediately after the vacation and posted case for hearing on 16.07.2013. A final decision is expected in three to four months from Hon PCAT.

1 MAY 13: Update on LDCE case at Hon. PCAT, New Delhi: Arguments from respondent’s side also concluded today and judgment reserved. SNEA (I) impleaded in the case in order to expedite the court case. Our lawyer strongly opposed the cancellation of the examination and pleaded that this examination was conducted for the vacancies from 2006-07 to 2009-10 and initially the examination was scheduled to be conducted in 2010. The examination is badly delayed and there should be no cancellation. Further Assn submitted that BSNL followed all the formalities before declaration of the results, and even if Hon Court in case finds any discrepancy in the final answer key, revaluation may be ordered, not re-examination. BSNL lawyer also strongly pleaded against any re-examination and made arguments very well. All the parties, both applicant as well as respondents agreed not to demand cancellation of the examination which the Hon Court recorded. Finally Hon Court directed BSNL to submit all the records related to finalization of final answer key like provisional answer key, representations received from all the parties, findings of the expert committee and examiner on the representations and final decision of BSNL Management, within two days and on perusal of the same judgment will be pronounced. GS, President and AGSs are present in the Hon Court during arguments.

1 MAY 13: Meeting with Sri M. F. Farooqui, Secretary, DoT on 30.04.2013: GS, President and AGS Com Arvind Pal Dahiya met Secretary, DoT and discussed the following issues:

a.      Requirement of a BSNL Management belongs to the company as pre-requite condition for the revival of BSNL,

b.     78.2% IDA merger with basic,

c.       Refund of BWA spectrum charges,

d.     Compensation for loss making Rural services and Telegraph services,

e.      Pension contribution on actual pay instead of maximum of the pay scale

f.       3G roaming and violation of 3G licenses by pvt operators.

            We clearly told Secy/DoT that unless and until BSNL is managed by its own Officers, none of the initiatives taken by the Govt can revive BSNL. Leaving the BSNL Board, for the last 12 years, all other senior positions are manned by officers on deputation from Govt and more than 70% of the Circles/states are headed by deputed officers on look after arrangement and on temporary basis. The absorbed officers are not promoted and posted to these key positions by the BSNL Management, to protect the interest of the unabsorbed officers on deputation, at the cost of BSNL. We explained the impact of the recent DoT order calling for volunteers which is even against the spirit of the cabinet decision. Secy/DoT assured that the order will be reviewed by DoT.

          On other issues of revival of BSNL, Secretary appreciated our concern and initiatives and informed that GoM will be dealing these issues shortly. Further he suggested to submit details of the issues to be taken up with GoM within a couple of days. We will be submitting a note in this regard. On 78.2% IDA merger also, Secretary was very positive and assured that DoT will take immediate action on receipt of comments from BRPSE.

1 MAY 13: Meeting with Sri V. Umashankar, Jt Secretary, DoT on 30.04.2013: GS, President and AGS Com Arvind Pal Dahiya met Jt Secretary, DoT and discussed the issues of 78.2% IDA merger with basic. He informed us that the proposal has gone to BRPSE for their comments and DoT will take a positive decision once the proposal is returned to DoT.On the issue of recent DoT order calling volunteers, Jt Secretary informed that he is unaware of the development and appropriate action will be taken by DoT.

 

30 APR 13: Update on LDCE case at Hon. PCAT, New Delhi: Today, arguments of applicant side were heard for more than One and Half hours. BSNL side and Associations side counter arguments will be heard tomorrow. SNEA (I) impleaded in the case. The arguments from applicants side (unsuccessful candidates) was mainly focused on ambiguous questions and pleaded for removal of the ambiguous questions and then revaluation. Some applicants pleaded for cancellation of the examination. GS, President and AGSs are present in the Hon Court during arguments.

Farooqui, Secretary DoT regarding payment of pension contribution --- Spirit and basis of provisions of Rule 37 A stipulating complete parity with 1972 CCS Pension Rules being defeated by forcing BSNL to pay pension contribution on maximum of basic pay in contravention of DOP&T order dated 19.11.2009. – BSNL has already paid about Rs 1,800 crores since 2007 (300 Crores per year) in excess of what it is to legitimately pay as pension contribution.
